Terms and Conditions of Sale

1. LEGAL NOTICE

The website www.kaparda.fr (hereinafter the “Site”) is open to anyone with a computer or smartphone and an internet connection.
It is published by:
Kaparda Paris, a simplified joint-stock company (SAS) with capital of €1,000, whose registered office is located at 9, rue Anatole de la Forge, 75017 Paris, registered with the Paris Trade and Companies Register (RCS) under number 889 009 262, Intra-Community VAT Number.

The Site allows Kaparda Paris to offer clothing (the “Products”) for sale to internet users browsing the Site (hereinafter the “Customer”).
These general terms and conditions of sale (hereinafter abbreviated “GTC”) apply to any Order placed on www.kaparda.fr for the purchase of Products presented on the Kaparda Paris Site.
Our Site operates partly on Pre-order (hereinafter “Pre-orders”) and partly on standard Order (hereinafter “Orders”). Any Pre-order or Order of Products presented on our Site requires prior review of these general terms and conditions of sale and their unconditional acceptance.
Kaparda Paris reserves the right to modify or adapt these general terms and conditions of sale at any time. However, in the event of a change, only the version of the GTC present on the Site on the day the Order is placed applies to the Pre-order or Order.
Any Customer placing a Pre-order acknowledges having read the target mentioned on each pre-order product page. If the target is not reached by the deadline, the Customer is fully refunded.
If a Customer buys an in-stock product, they acknowledge that it is no longer possible to change the size after receipt.
If a Customer wishes to be refunded for a product purchased as a Pre-order or in stock, they must submit a request. The refund process begins upon receipt of the returned item.

2. PRODUCTS

In accordance with Article L. 111-1 of the French Consumer Code, Kaparda Paris presents the Products and their characteristics on the Site. This allows the Customer to review the characteristics of each desired Product before finalizing the Order.
Photos on the Site representing the products are for illustrative purposes only. These photos and the text describing the products cannot be considered part of the contractual terms.
Products offered for Pre-order by Kaparda Paris are only valid within the defined time limit and the available Pre-order quantity.
In-stock Products are only valid while stocks last.

3. PRICE

Prices shown on www.kaparda.fr are expressed in Euros, including all taxes. Kaparda Paris reserves the right to change prices at any time, without notice. It is agreed that the Products presented are supplied at the rates in effect on the Site at the time the Customer confirms the Order.
The prices shown do not include shipping costs, which are billed separately and indicated when the Order is confirmed. Prices take into account the VAT applicable at the time of the Pre-order or Order. Prices also reflect any change in the VAT rate that affects the prices of the Products presented on the Site. The full price must be paid when the Order is confirmed.
For all Products shipped outside the European Union and French overseas territories, prices will be calculated exclusive of tax. Customs duties, import taxes, and other charges may apply. These costs are the responsibility of the Customer, who is considered the importer.

4. PAYMENT

The price is paid when the Order is confirmed. The Customer has a single payment method available: credit card. Accepted cards are: MasterCard, Visa, American Express, Diners Club, JCB, Discover.
For card payments, the Customer agrees to provide their card number, the security code on the back of the card, and the card’s expiration date. For a secure payment, the Customer accesses a dedicated space provided by the payment company Stripe. In this regard, the Customer acknowledges that providing their card details to Kaparda Paris via Stripe constitutes authorization to debit their account in exchange for the Products ordered.
Payments made by the Customer are considered final only once the amounts due have actually been collected by Kaparda Paris.
Kaparda Paris reserves the right to refuse delivery of a Product if the Customer does not pay the full price under the conditions indicated above.

5. ORDERS AND PRE-ORDERS

Any Order or Pre-order placed on the Site is confirmed when the Customer clicks “Place my Order.” This confirmation implies the Customer’s acceptance of the GTC and the characteristics of the Products presented on the Site.
In the case of a Pre-order, if the minimum target is not reached, Kaparda Paris will contact the Customer to announce its decision to refund or proceed with production. From the day the Pre-order is cancelled, Kaparda Paris has 14 days to refund the Customer.
In-stock Products are available as long as they are visible on the Site. The Order is fulfilled no later than 7 days from the day after the Customer placed the Order. If the product is unavailable due to supplier issues, the Customer will be informed as soon as possible and will have the option to cancel their Order.
The refund is issued no later than 14 days after the Order is cancelled.

6. DELIVERY

6.1 Delivery location
The delivery location is the address provided by the Customer when finalizing the Order. This must be the Customer’s residential address or that of an individual of their choosing. Delivery cannot be made to PO boxes or hotels.
When registering their personal details, the Customer must ensure the accuracy of the information provided. In the event of an error, Kaparda Paris declines all responsibility for any failure to deliver.
6.2 Delivery times
Delivery times are expressed in days at the time of the Order. The times indicated correspond to average processing and delivery times.
The Customer acknowledges that delivery time may be extended in the case of a Pre-order. Delivery time depends on production time and the volume of pre-ordered Products.
Kaparda Paris cannot be held responsible for the consequences of a delivery delay beyond its control or due to a case of force majeure.
6.3 Receipt of Products
Receipt is considered effective as soon as the Products are handed over to the Customer by the carrier, as evidenced by the carrier’s tracking system.
Upon receipt of the Products, the Customer must check the condition of the packaging and report any damage caused by the carrier on the delivery note. The Customer must also email Kaparda Paris within three (3) days.
Shipping costs are the Customer’s responsibility, both in France and worldwide. Return shipping costs are covered by Kaparda Paris, unless the delivery address is outside France. We cover return shipping costs for our international Customers in the event a product is non-compliant.

7. LEGAL WARRANTY

Kaparda Paris is only liable for defects of conformity existing at the time of delivery of the Product, under the conditions set out in Articles L. 217-4 et seq. of the French Consumer Code.

8. RIGHT OF WITHDRAWAL

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Customer has a period of fourteen (14) days from receipt of the Products to exercise their right of withdrawal on their Order.
The Customer must include with their withdrawal request a copy of the invoice allowing identification of the product and its owner.
Only the Customer identified as such by Kaparda Paris may exercise this right.

9. RETURN AND REFUND PROCEDURES

Any return or exchange must be reported by the Customer to Kaparda Paris via the Site’s contact form. A printed withdrawal form is included in every package delivered to the Customer.
The Products must be returned by the Customer within fourteen (14) days of notifying their decision to withdraw.
Products must be returned in their original packaging and in perfect condition for an exchange or refund.
If the package is damaged or lost during return, the cost of the damage is payable by the Customer.
Products not returned under the conditions and within the timeframes stated above will be neither exchanged nor refunded by Kaparda Paris.
The refund will be made by crediting the Customer’s bank account associated with the card used to pay for the Order or Pre-order.

10. APPLICABLE LAW

These GTC and the transactions arising from them are governed by French law. In the event of a dispute or complaint, the Customer should contact Kaparda Paris first to seek an amicable solution.
The Customer may use a consumer mediator free of charge for the amicable resolution of a dispute with a professional.
Failing mediation, the courts having jurisdiction over Kaparda Paris’s registered office shall have authority.

11. DATA PROTECTION

To provide the services offered on the Site, Kaparda Paris may need to process your personal data provided when registering on the Site or placing your Order.
Information and data concerning the Customer are necessary for managing Orders and for carrying out and following up on the business relationship. This information and data are also useful for internal statistics.

In accordance with the French law of January 6, 1978, the Customer has the right, at any time, to access, rectify, and object to their personal data. To do so, simply contact Kaparda Paris, and the necessary steps will be taken
